Welcome to the SOUND website. This Privacy Policy describes what information we collect from you when you visit or make a purchase from www.soundsnacking.com (the “Site” or our “Site”), how we use and share such information, and the choices you have regarding our information collection and use. This Privacy Policy applies to information we collect about you through our Site and when you otherwise communicate with us. This Policy supplements and forms a part of our Terms of Use. Capitalized terms not defined here have the meaning given to them in our Terms of Use.

This Privacy Policy applies to information collected about you by SOUND Foods, Inc., dba SOUND (the "Company") and our third-party service providers.

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. Additionally, when you make a purchase or attempt to make a purchase through the Site, request information, register as a user, or otherwise communicate with us or otherwise interact with us, we and our third-party service providers collect certain information you provide directly to us, including your name, email address, shipping and billing address, phone number or credit card number. We refer to this information as “Personal Information”, information that personally identifies or can be associated with you.

When we talk about “Information” in this Privacy Policy, we are talking both about Personal Information and Device Information. This Privacy Policy does not apply to any third parties or any websites that might be linked to our Site or products.

We collect Information about your use of the Site, including the pages you visit. That Information may be linked to your email address if you provide it to us. We also collect Information about you from third parties, including other online services and our business partners. We may use or combine any of the Information collected about you for any of the purposes described in this Privacy Policy.

CATEGORIES OF INFORMATION WE COLLECT

Personal Information You Provide to Us: Personal Information includes your name, address (both billing and shipping addresses), email address, credit card information, phone number and any other information attributable to an identifiable natural person or household, including the information described in California Civil Code Section 1798.140(o). Each piece individually is a piece of Personal Information, and we collect varying amounts of Personal Information based on how you engage with us. We collect Personal Information when you order a product from us, register to receive communications from us, create an online account on our Site, request or subscribe to product information, promotions or other communications from us, contact or communicate with us, participate in surveys, enter contests or promotions, submit a product review, testimonial, comment, suggestion, or other content to us, access or use our pages or accounts on any third-party social media platforms such as Instagram, Facebook, Twitter, or Pinterest, or otherwise interact with us online through our Site or by phone, mail, or in person. We may gather your birthday as well as your contact information, including physical, shipping and e-mail address, your country of residence and preferred language. We do not collect payment or credit card information from you; when you purchase a product or otherwise make a payment through the Site, your card information is received directly by our card processing service provider and not to or through our systems. We do collect information relating to your purchase, including the amount of your purchase, the products that are purchased, your shipping address and a transaction reference number. Based on how you interact with us and the information you share, we use the Personal Information we collect to process and communicate with you about your order, establish a customer relationship with you, ship the products you ordered, process payments, enhance your shopping experience, communicate with you about our products and events that may be of interest to you, and for other marketing and research purposes.

Device Information Collected Automatically: Our Site uses various tracking technologies that may include cookies, log file information, web beacons, location data, online analytics, and third-party ad serving companies (collectively, "Tracking Tools") to automatically collect Information from you. We, along with our third-party service providers, use Tracking Tools for a variety of purposes, including enhancing your online experience and our product offerings. Cookies: We and our third-party service providers use cookies, which are small files that are stored on your computer or mobile device and allow websites to remember information about you. Log File Information: Log file information may be automatically reported by your browser or mobile device each time you access the Site. This Information may include your IP address, device and software characteristics (such as type and operating system), browser type, Internet service provider, URLs, referring/exit pages, date/time stamps, click data, domain names, landing pages, pages viewed, and other such information.

Web Beacons: When you use the Site, we and our third-party service providers may employ web beacons (also known as clear gifs or action tags) that are used to anonymously track your online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. This information facilitates more accurate reporting and improvement of our Online Services.

Location Data: When you access our Site via a mobile device, we and our third-party service providers may access, collect, monitor, and/or remotely store information regarding your mobile device, as well as real-time "location data," which may include GPS coordinates. Your device should require you to provide permission before our Site obtains precise geolocation information from a browser's geolocation API or from technologies like GPS, Wi-Fi, and/or cell towers. We and our service providers may use this approximate location and/or precise geolocation information, along with other information submitted by you, to provide you with location-based services like local store information, search results, special offers, and other personalized content. Online Analytics: We use third-party analytics tools to help us measure traffic and usage trends. These tools collect Information sent by your browser or mobile device, including the pages you visit and other Information, which assists us in improving our Online Services and offerings.

Third-Party Ad Serving Companies: We may use certain third-party web analytics services and advertising companies, such as Google Analytics, DoubleClick, Yotpo, and Facebook Custom Audiences, to help us understand and analyze how visitors use our Site and serve ads on our behalf across the Internet after you visit our Site. We’ve implemented Google Analytics Advertising features such as Remarketing with Google Analytics, Google Analytics Demographics and Interest Reports, Google Ads Remarketing, Google Ads Similar Audiences, and Google Signals. We and third-party vendors also may separately use Tracking Tools, including first-party cookies or other first-party identifiers and third-party cookies or other third-party identifiers to provide information to service providers that help us operate and manage our Site, advertise, market or promote our products, deliver targeted advertisements to our Online Services, process orders, and fulfill and deliver products that you purchase from us. Send to a Friend: We may give you the opportunity to tell your friends about product information and promotions. If you take advantage of our Send to a Friend option, we ask you for your friend's and your first names, last names and email addresses to send the information to them that you requested.

USER-GENERATED CONTENT (USER POSTS / PRODUCT REVIEWS / SHARE THIS)

The Site may enable users to submit their own content for product reviews and other functions (“User-Generated Content”). We or others may store, display, reproduce, publish, distribute, or otherwise use User-Generated Content online or offline in any media or format (currently existing or hereafter developed) and may or may not attribute it to you. Others may have access to this User-Generated Content and may have the ability to share it with third parties. If you choose to submit User-Generated Content to any public area of our Site, your User-Generated Content will be considered “public” and will be accessible by anyone. Please note that we do not control who will have access to the information that you choose to make available to others and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. Any Information that you post to social media platforms such as Instagram, Facebook, Twitter, or Pinterest or using a "share this" feature may be seen, collected, and used by anyone who has access thereto, including, without limitation, your user/screen name. You are responsible for all actions resulting from any Information, including Personal Information, which you post via a social media platform. From time to time, we will re-post or otherwise use in our advertising a consumer’s photos, experiences, stories, or other content from their personal social media account. YOUR CHOICES ABOUT HOW WE USE YOUR INFORMATION

We provide you with the opportunity to update and/or delete certain Personal Information and to opt-out of having your Personal Information used or disclosed for certain purposes. For example, you may:

  • correct or update your Personal Information;
  • change your preferences for certain communications (e.g., catalogues, product offers and volume of emails to receive);
  • request that we do not share your Personal Information with third parties for their marketing purposes;
  • request access to your Personal Information; and/or
  • close your online account.

Because we plan our communications in advance, it may take up to several weeks for your request to become effective. Please note that we are only required to respond to one request per customer each year.

We will make reasonable good faith efforts to remove the post from prospective public view or anonymize it so the minor cannot be individually identified. However, this removal process cannot ensure complete or comprehensive deletion from the Internet. For instance, third parties may have republished the post and/or archived copies of it may be stored by search engines or other parties that we do not control.

CHILDREN’S PRIVACY

The Site is Intended for use only by persons 18 years of age or older. By using our Site, you represent that you are at least 18 years of age.
